Definitions and Interpretation

In these Terms of Service, the following definitions apply:

"HealthNav", "we", "us", "our"

Means HealthNav, a product of QuestFeed Pty Ltd (ABN 58 632 013 855), an Australian Private Company registered in Queensland.

"Platform"

Means the HealthNav website at healthnav.au, including all pages, content, and functionality.

"Services"

Means all services provided through the Platform, including healthcare provider search, directory listings, and related features.

"User", "you", "your"

Means any individual or entity accessing or using the Platform.

"Healthcare Provider"

Means any registered health practitioner, healthcare facility, practice, clinic, or support worker listed on the Platform.

"Health Information"

Has the meaning given in the Privacy Act 1988 (Cth) and includes information about your symptoms, health conditions, and healthcare preferences.

Medical advice, diagnosis, or treatment
Guarantee of provider availability or quality
Real-time registration verification
Endorsement of any specific provider
Appointment booking services
Replacement for professional medical consultation

Acceptance of Terms

By accessing or using the Platform, you acknowledge that you:

Have read, understood, and agree to be bound by these Terms of Service

Have read and agree to our Privacy Policy

Are at least 18 years of age, or have parental/guardian consent

Have the legal capacity to enter into a binding agreement

Will use the Platform only for lawful purposes and in accordance with these Terms

Changes to Terms: We may modify these Terms at any time. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

Use of the Platform

Permitted Use

You may use the Platform to:

  • Search for healthcare providers across Australia
  • View publicly available information about healthcare providers
  • Make informed decisions about your healthcare choices
  • Contact healthcare providers using the information provided

Prohibited Conduct

You must NOT:

  • Scrape, harvest, or collect data using automated means without consent
  • Attempt to gain unauthorized access to the Platform or its systems
  • Upload viruses, malware, or harmful code
  • Harass, abuse, or harm healthcare providers or individuals
  • Use provider information for spam or unsolicited marketing
  • Post false reviews or misleading information

Data Sources

Healthcare provider information is sourced from:

AHPRA

Australian Health Practitioner Regulation Agency public register

Government Databases

Publicly available healthcare facility databases

Provider-Submitted

Information provided directly by healthcare providers

Public Sources

Publicly listed business information

Accuracy Notice

While we strive to maintain accurate information, we cannot guarantee all data is current or error-free. Provider details may change. Always verify critical information directly with healthcare providers. For current AHPRA registration status, visit ahpra.gov.au.

Terms for Healthcare Providers

Healthcare providers listed on the Platform must comply with:

AHPRA Advertising Guidelines

All profile content must comply with the Health Practitioner Regulation National Law and AHPRA's Guidelines for advertising regulated health services.

Australian Consumer Law

Providers must not make false or misleading claims about their services or qualifications.

Professional Standards

Applicable codes of conduct for the relevant profession must be followed at all times.

Intellectual Property

The Platform and its original content are owned by QuestFeed Pty Ltd and protected by Australian and international intellectual property laws. This includes:

  • The HealthNav name, logo, and branding
  • Website design, layout, and user interface
  • Software, code, and technical infrastructure
  • Data compilations and database structures

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

Disclaimers and Limitations

No Medical Advice

The Platform is for informational purposes only and does not constitute medical advice. Always seek the advice of a qualified health practitioner for any health concerns. Never disregard professional medical advice or delay seeking it because of information on this Platform.

Disclaimer of Warranties

To the maximum extent permitted by law, the Platform is provided "as is" and "as available" without warranties of any kind, including:

  • Implied warranties of merchantability or fitness for a particular purpose
  • Warranties that the Platform will be uninterrupted or error-free
  • Warranties regarding accuracy or completeness of information

Limitation of Liability

To the maximum extent permitted by Australian law:

  • We shall not be liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed $100 AUD or amounts paid in the past 12 months
  • We are not liable for acts or services of listed healthcare providers

Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded by agreement.

Additional Terms

9 Indemnification

You agree to indemnify and hold harmless HealthNav, QuestFeed Pty Ltd, and its directors, officers, and employees from any claims arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

10 Privacy

Your use of the Platform is governed by our Privacy Policy, which describes how we collect, use, and protect your information in accordance with the Privacy Act 1988 (Cth).

11 Third-Party Links

The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of external sites. When you click through to a healthcare provider's website, your interaction is governed by their terms.

12 Termination

We may terminate or suspend your access without prior notice if you breach these Terms, engage in fraudulent activity, or for any reason at our sole discretion. Upon termination, your right to use the Platform immediately ceases.

13 Governing Law

These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia.

14 General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and HealthNav.
  • Severability: If any provision is unenforceable, remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not constitute a waiver.
  • Assignment: You may not assign these Terms without our consent.
